How Do I Get a Group Home License in My Area??

One of the main excuses we get from people who believe they can’t start a Group Home in the next 30 – 60 days usually goes something like this:

“That won’t work in my area. In the state of (Blank) you are required to (Blank) before you can open a Group Home.”

That second blank is usually filled in with “Get a Group Home License” which will then send them down a very time consuming, costly, and confusing process researching how to become a licensed facility.

Look, if you have the money, time, and desire to become licensed there are some advantages, but it is not REQUIRED.

Follow the same rules and regulations that EVERYONE ELSE needs to follow…and your area can’t regulate your home just because you are housing seniors, males, females, former inmates, veterans, all of the above, or any other segment of the population. If they do…or try to…they would be in direct violation of the FEDERAL Fair Housing Act!

So what are some of these local Group Home laws you need to follow and where do you find them?

Every city, county and state is going to have different “property code” where they regulate everything down to the length of the grass you can have! You can usually find the full code by searching the following terms:
“(BLANK) County Property Code” or something similar
There are some rules that could hinder your business or limit the amount of income you can make, so we definitely recommend finding these out!

1) How many tenants per square feet?
This will vary depending on location, but in general you should be able to get at least 2 people per bedroom as long as it is not a very small house. Check out THIS ARTICLE for more details.
2) Are there any maximum occupancy laws?
Some areas like SAN ANTONIO do not allow more than 6 unrelated occupants to live in a single family home. If you are in an area like this, it might make sense to focus on Three-Bedroom homes.
3) Do they limit outsourced care?
PENNSYLVANIA is the only place I’m aware of with laws like this, but you cannot used outsourced licensed care for more than three occupants in a home. So the obvious answer to this is limit the amount of tenants that need licensed care! You can focus on functioning adults to avoid this altogether.
4) Is there any additional “Registration” required?
In places like PHOENIX and possibly LOUISVILLE (not sure of the outcome on this one) they want “boarding homes” to be “registered”. This involves minimal paperwork, small fees, and they struggle with enforcement since this can be contested with Federal law.

Now 3 and 4 could probably be contested under the Fair Housing Act, but they are not extremely restrictive.
The main point is….

A GROUP HOME LICENSE IS NOT REQUIRED!

Follow the same rules any other housing provider needs to follow (AKA Landlord), do not perform care that requires a license you don’t have, don’t advertise that you do if you don’t, and keep up with your home just like anybody else is required to!
